These Terms of Service (“Terms”) govern your access to and use of OnOffMyPC — the websites, web app, mobile apps, APIs, and related services that let you remotely control PC power through an ESP32 device (together, the “Service”). The Service is operated under the name OnOffMyPC (the “Operator”).

By creating an account, accessing the Service, or completing a purchase when paid features are offered, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Business customers who enter a separately signed Master Service Agreement (“MSA”) are also governed by that MSA for the agreed arrangement. Consumer self-serve use and device unlocks remain under these Terms and the Refund Policy.

1. Eligibility

You must be at least 16 years old (or the minimum age of digital consent in your country) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Accounts

You must provide a valid email address to register, or sign in with a supported identity provider (for example Google, Apple, or Microsoft when enabled). You are responsible for all activity under your account and for keeping credentials and session devices secure. Notify us immediately at [email protected] if you believe your account has been compromised.

You may delete your account from the app (Account → Delete account) or by contacting support. Deletion follows a short grace period before permanent purge, as described in the Privacy Policy.

3. The Service

OnOffMyPC routes power-related commands (for example power on, power off, reset) and related status/telemetry between your account and hardware you register. Power-on typically depends on Wake-on-LAN and your local network setup. The Service is not a VPN, remote desktop, or safety-critical control system.

Access is currently free during the public launch. Paid device unlocks or other paid features may be enabled later. Pricing and availability may change; we will show applicable pricing before checkout when paid unlocks are offered.

4. Acceptable use

You may use the Service only to control hardware that you own or have explicit permission to control. You must not:

5. Service availability and no guarantees

OnOffMyPC is a live production service. We use commercially reasonable efforts to keep it available, but we do not guarantee uninterrupted uptime, and we do not promise specific availability percentages (for example 99.99%) unless agreed in a separate MSA.

We make no guarantees that commands sent through the Service will be delivered or executed. Factors outside our control — internet connectivity, Wi-Fi, device power state, hardware failure, Wake-on-LAN configuration — can prevent delivery or physical effect. Do not rely on this Service for time-critical, life-safety, industrial, medical, or other safety-critical operations.

Features may be improved, limited, or adjusted over time, and temporary maintenance windows may occur.

6. Purchases, Polar, and refunds

When paid device unlocks are offered, they are sold as a one-time unlock for the device selected at checkout — not a recurring subscription — unless we clearly state otherwise. The price shown before checkout may be accompanied by taxes or local currency presentation where applicable.

Payment collection, taxes, invoices, receipts, and refunds are provided by Polar, which acts as merchant of record and authorised reseller when checkout is available. By completing checkout you also agree to Polar’s Checkout Buyer Terms. A checkout return page is not proof of payment; access is granted only after we receive a verified paid-order notification from Polar.

Refunds are described in our Refund Policy. In summary: contact [email protected]; a full refund revokes the corresponding device unlock; a partial refund does not automatically revoke it. Polar may set final refund processing rules. Nothing in these Terms limits rights that cannot legally be waived.

7. Intellectual property

The Service — including software, documentation, branding, and site content — is owned by the Operator or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your personal or internal business purposes as offered.

Firmware, open-source components, and third-party libraries may be subject to their own licenses. You retain ownership of your account content and device configuration data; you grant us a limited license to host and process that data solely to provide the Service.

8. Third-party services

The Service depends on third parties such as Cloudflare (hosting and edge infrastructure), Resend (transactional email), Polar (checkout when enabled), push providers (for example Firebase Cloud Messaging), and identity providers when you choose social sign-in. Their terms and privacy practices apply to their processing.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING FAILURE OF A POWER COMMAND TO DELIVER OR EXECUTE — EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO THE OPERATOR (OR TO POLAR FOR ONOFFMYPC UNLOCKS) FOR THE SERVICE IN THAT PERIOD, OR (B) USD $50 IF YOU HAVE NOT PAID.

Some jurisdictions do not allow certain limitations; in those cases the limitation applies only to the extent permitted. Nothing excludes liability that cannot be excluded by law (for example fraud or death/personal injury caused by negligence where such exclusion is void).

Cyber, product, or other insurance coverage for the Operator’s business, if any, is an operator responsibility outside these consumer Terms and is not a customer entitlement under the Service.

11. Indemnity

You will defend and indemnify the Operator against reasonable losses and expenses arising from (a) your unauthorized control of hardware or networks, (b) your breach of these Terms, or (c) your violation of law, except to the extent caused by the Operator’s willful misconduct.

12. Termination

We may suspend or terminate accounts that violate these Terms, pose a security risk, or abuse the Service. You may stop using the Service and delete your account at any time. Sections that by nature should survive (including intellectual property, disclaimers, liability limits, indemnity, and governing law) survive termination.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a revised “Last updated” date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms, except where applicable law requires a different process for material changes.

14. Governing law and disputes

These Terms are governed by the laws applicable where the Operator is established, without regard to conflict-of-law rules, except that mandatory consumer protections in your country of residence continue to apply. Courts with jurisdiction over the Operator’s place of establishment will hear disputes, subject to those mandatory consumer rights. If a formal legal entity and jurisdiction are later published on this site, that notice will control.
